This Privacy Policy explains how 3A Capital Group, LLC d/b/a Infinity Technologies ("Infinity AI," "we," "us," or "our") collects, uses, shares, and protects information in connection with Infinity AI, our software-as-a-service real estate automation and artificial intelligence platform (the "Service"). The Service is delivered through the GoHighLevel platform.

This Policy applies to our subscribers and to visitors of our websites and applications. It works alongside our Terms & Conditions. By using the Service, you agree to this Policy.


1. The Two Roles We Play

Because the Service is used by real estate professionals to manage their own contacts, it is important to understand who controls which data:

1.1 When we are the controller. For information about our subscribers and website visitors (such as account, billing, and usage data described below), we determine how and why the data is processed, and this Policy governs that processing.

1.2 When we are a processor / service provider. When a subscriber uploads, imports, or generates information about their own clients, leads, prospects, or other contacts ("Contact Data"), the subscriber is the controller of that data and we process it on their behalf and under their instructions. If you are a consumer, lead, or client of one of our subscribers and want to access, correct, or delete your information, please contact that subscriber (the real estate professional or business you interacted with) directly. We will assist our subscribers in responding to such requests as required by law.


2. Information We Collect

2.1 Information you provide.

Account information: name, business name, email, phone number, and login credentials.

Billing information: payment details processed by our payment processor (we do not store full card numbers).

Support and communications: information you share when you contact us, respond to surveys, or request support.

2.2 Contact Data submitted by subscribers. Information our subscribers upload, import, or generate through the Service about their contacts, which may include names, phone numbers, email addresses, property interests, message history, and notes.

2.3 Communications content. Messages, emails, call records, and AI-assisted conversations sent or received through the Service, including content generated by our AI features.

2.4 Information collected automatically. When you use the Service or visit our sites, we and our providers may collect device and usage data such as IP address, browser type, pages viewed, actions taken, timestamps, and similar log data, including through cookies and similar technologies (see Section 7).

2.5 Information from third parties. We may receive information from the GoHighLevel platform, integrated services, payment processors, and analytics providers that support the Service.


3. How We Use Information

We use information to:

Provide, operate, maintain, and improve the Service;

Create and manage accounts and process payments;

Power AI features, automations, messaging, and related functionality;

Provide customer support and respond to requests;

Monitor usage, prevent fraud and abuse, and maintain security;

Comply with legal obligations and enforce our Terms;

Communicate with you about your account, updates, and (where permitted) marketing.

We do not sell personal information.


4. AI Processing

The Service uses artificial intelligence, including third-party large language model providers, to generate text, responses, recommendations, and other output. To provide these features, relevant input data (which may include Contact Data and communications content) is processed by these AI systems. We take reasonable steps to work with providers under terms that restrict the use of this data to delivering the Service. AI output may be inaccurate and should be reviewed before use, as described in our Terms.


5. SMS and Messaging Consent

If you opt in to receive SMS/text messages from us, message and data rates may apply, and message frequency varies. You can opt out at any time by replying STOP, and reply HELP for help.

We do not sell or share mobile opt-in information or SMS consent with third parties or affiliates for their marketing purposes. Information obtained as part of an SMS consent program is used solely to deliver the messages you have requested and is not shared with third parties for marketing.

Subscribers who use the Service to send messages to their own contacts are responsible for obtaining all required consent from those contacts and for honoring opt-out requests, as described in our Terms.


6. How We Share Information

We share information only as needed to run the Service and as described here:

Service providers / subprocessors: including the GoHighLevel platform, AI/large language model providers, telephony and messaging carriers, email delivery providers, payment processors, hosting, and analytics providers, who process data on our behalf under appropriate obligations.

With subscribers: Contact Data is accessible to the subscriber who controls it.

Legal and safety: when required by law, subpoena, or legal process, or to protect the rights, property, or safety of Infinity AI, our users, or others.

Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.

We do not sell personal information, and we do not share it for cross-context behavioral advertising.


7. Cookies and Tracking Technologies

We and our providers use cookies and similar technologies to operate our sites, remember preferences, analyze usage, and improve the Service. You can control cookies through your browser settings, though disabling them may affect functionality.


8. Data Retention

We retain personal information for as long as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements. Contact Data is generally retained according to the subscriber's instructions and account status. After termination, we may delete or de-identify data following a reasonable retention period, unless longer retention is required by law.


9. Data Security

We implement reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.


10. Your Privacy Rights

Depending on where you live, you may have rights regarding your personal information, including the right to access, correct, delete, or obtain a copy of your information, and to opt out of certain processing. This includes residents covered by the Texas Data Privacy and Security Act (TDPSA), the California Consumer Privacy Act as amended (CCPA/CPRA), and similar state laws.

To exercise these rights with respect to information for which we are the controller, contact us at [email protected]. We will respond as required by applicable law and will not discriminate against you for exercising your rights. You may appeal a decision regarding your request by replying to our response.

If your information was provided to us by one of our subscribers (Contact Data), please direct your request to that subscriber, as they control that data.


11. Children's Privacy

The Service is intended for businesses and is not directed to children under 18. We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will take appropriate steps to delete it.


12. Data Location

We operate in the United States, and information we process is generally stored and processed in the United States. If you access the Service from outside the United States, you understand your information may be transferred to and processed in the United States.


13. Third-Party Links and Services

The Service may link to or integrate with third-party websites and services, including GoHighLevel. We are not responsible for the privacy practices of those third parties, and their use of your information is governed by their own privacy policies.


14. Changes to This Policy

We may update this Policy from time to time. When we make material changes, we will update the "Last Updated" date and provide notice as appropriate. Your continued use of the Service after changes take effect constitutes acceptance of the updated Policy.
