Usage-Based Fees & Billing Terms

These Usage-Based Fees & Billing Terms ("Fee Terms") govern the consumption-based charges that apply to your use of the Infinity platform ("Infinity," "the Platform," "we," "us," or "our"), operated by 3A Capital Group, LLC, a Texas limited liability company. These Fee Terms are incorporated into and form part of your overall agreement with us, including our Terms of Service and Privacy Policy. By creating an account, activating a feature that consumes usage, or continuing to use the Platform, you agree to these Fee Terms.
1. Two Types of Charges
Your relationship with Infinity involves two distinct categories of charges:
Subscription fees. Your monthly or annual plan fee covers access to the Platform, its core features, and the tools included in your selected tier. These are billed on a recurring basis according to the plan you selected at signup.
Usage-based fees. Certain features rely on third-party services — including telephony, messaging, email delivery, artificial intelligence processing, and domain registration — that are billed according to how much you use them. These usage-based fees are separate from and in addition to your subscription fee. They are charged based on your actual consumption and are not included in, capped by, or offset against your subscription.
Activating, enabling, or leaving these features running on your account will generate usage-based fees, whether or not you actively monitor them.
2. Current Rate Schedule
The following rates reflect current usage pricing. All amounts are in U.S. dollars (USD). Rates are subject to change as described in Section 5.
Phone & Messaging
Outbound calls — $0.028 per minute
Inbound calls — $0.017 per minute
Text messages (SMS) — $0.0166 per segment
A single text message may consist of multiple segments depending on length and content. Longer messages, special characters, and media may increase the number of segments billed.
Email sends — $0.0017 per email
Email verification — $0.0138 per verification
AI Features
Conversation AI — $0.05 per message
Voice AI — $0.325 per minute of voice call
Content AI (text) — $0.18 per 1,000 words
Content AI (images) — $0.12 per image
Reviews AI — $0.025 per review response
Funnel AI — $1.98 per funnel
Ask AI — $3.165 per 1,000,000 tokens
External AI Models in workflows (input) — $1.50 per 750,000 words
External AI Models in workflows (output) — $6.00 per 750,000 words
Automation
Premium Workflow features — $0.02 per execution
Domains
Domain purchase — $15.00 per domain
Domain purchases are one-time or renewal charges billed at the time of purchase or renewal and are generally non-refundable once registered.
3. How Usage Is Measured and Billed
Usage is measured by our systems and our third-party providers based on the units described above (per minute, per segment, per email, per message, per token, per execution, per image, and so on). Measurement records maintained by us and our providers are the definitive record of your usage for billing purposes, absent clear evidence of error.
Usage-based fees are billed to the payment method on file, either as they accrue, on a periodic basis, or by drawing down a prepaid balance, depending on your account configuration. Where your account uses a prepaid balance or automatic recharge, enabling that setting authorizes us to charge your payment method to replenish the balance when it runs low, so that your automations and AI features continue running without interruption.
You authorize our payment processors and us to charge your payment method for all usage-based fees incurred by your account.
4. Your Responsibility for Usage
You are solely responsible for all usage generated through your account, including usage generated by:
Automations, workflows, and sequences you build, enable, or leave running
AI features you activate, including chat agents, voice agents, and content generation
Messages, calls, and emails sent by your account, whether initiated manually or automatically
Team members, sub-accounts, or other users with access to your account
Any misconfiguration, loop, or unintended trigger within automations you control
This responsibility applies regardless of whether the usage was intentional, whether you were actively monitoring your account, and whether the resulting volume was higher than you anticipated. We strongly recommend reviewing your automation logic and AI settings before activating them at scale, and monitoring your usage regularly.
We are not responsible for usage-based fees resulting from your own configuration choices, third-party integrations you connect, or unauthorized access to your account arising from your failure to secure your login credentials.
5. Rate Changes
Usage rates are determined in significant part by our third-party service providers, and those providers may change their pricing at any time. As a result, the rates in Section 2 may change.
We reserve the right to modify usage rates at any time. Where a change is material and within our control, we will make reasonable efforts to notify you in advance through the Platform, by email, or by updating these Fee Terms. Your continued use of a usage-based feature after a rate change takes effect constitutes acceptance of the updated rate. If you do not agree to a change, your remedy is to stop using the affected feature.
Rates that change due to third-party provider adjustments, regulatory changes, or carrier fees may take effect with limited or no advance notice.
6. Taxes and Regulatory Fees
Usage-based fees are exclusive of any applicable taxes, levies, surcharges, or regulatory fees. You are responsible for any sales, use, telecommunications, or similar taxes and any carrier or regulatory pass-through fees associated with your usage, except for taxes based on our net income. Where we are required to collect such amounts, they will be added to your charges.
Messaging and telephony usage may be subject to carrier fees, registration fees (including A2P/10DLC campaign and brand registration), and regulatory surcharges that are billed in addition to the per-unit rates above.
7. Messaging and Telephony Compliance
Your use of phone, SMS, and email features must comply with all applicable laws and carrier requirements, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, A2P/10DLC registration requirements, and the rules of the carriers and providers we use. You are responsible for obtaining and maintaining all necessary consents from the individuals you contact.
We may suspend or restrict your messaging and telephony features if your usage generates excessive complaints, violates carrier policies, or exposes us or our providers to regulatory risk. Fees already incurred remain payable.
8. No Refunds on Consumed Usage
Usage-based fees represent services that have already been delivered and consumed at the time they are billed. Except where required by law, usage-based fees are non-refundable, including fees resulting from automations, AI features, or messages sent by your account. This applies even where the usage exceeded your expectations or was generated in error on your side.
Prepaid balances, where offered, may be non-refundable or refundable only as to the unused portion, as specified at the time of purchase.
9. Non-Payment and Suspension
If a charge for usage-based fees fails, is reversed, or remains unpaid, we may:
Retry the charge against your payment method
Suspend or disable usage-based features on your account
Suspend your account until the outstanding balance is paid
Apply reasonable late fees or interest to the extent permitted by law
Suspension of usage-based features does not relieve you of your obligation to pay fees already incurred, and does not by itself cancel your subscription. We are not liable for any loss of leads, appointments, messages, or business resulting from suspension due to non-payment.
10. Disputes and Chargebacks
If you believe a usage-based charge is incorrect, contact us within thirty (30) days of the charge so we can review it with you. We will investigate in good faith and correct any verified billing error.
Initiating a chargeback or payment dispute without first contacting us may result in suspension of your account. You agree to work with us in good faith to resolve billing questions before disputing a charge with your card issuer or bank.
11. Third-Party Providers
Many usage-based features are powered by third-party providers, including telephony, messaging, email, AI, and domain registration services. The availability, performance, quality, and pricing of these features depend on those providers.
To the fullest extent permitted by law, we are not responsible for outages, degraded performance, delivery failures, delays, inaccurate AI outputs, or price changes attributable to third-party providers. Your use of these features is also subject to the applicable third-party terms. Usage fees remain payable for services rendered even where a third-party provider's performance did not meet your expectations.
12. Limitation of Liability
To the fullest extent permitted by law, our total liability arising out of or relating to usage-based fees, whether in contract, tort, or otherwise, shall not exceed the amount of usage-based fees you paid to us for the specific feature at issue during the three (3) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost leads, or lost business, arising from the operation, suspension, or pricing of usage-based features.
Nothing in these Fee Terms limits liability that cannot be limited under applicable law.
13. Changes to These Fee Terms
We may update these Fee Terms from time to time. The "Last updated" date at the top reflects the most recent version. Material changes will be communicated as described in Section 5. Your continued use of usage-based features after an update takes effect constitutes acceptance of the revised Fee Terms.
14. Governing Law
These Fee Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Fee Terms shall be subject to the venue and dispute-resolution provisions set out in our Terms of Service.
